INVITATION FOR BIDS
FOR THE OPERATION OF “PIER 53” FOOD AND DRINK CONCESSION
AT WIND CREEK STATE PARK
Notice is hereby given to all interested persons that the State of Alabama, Department of Conservation and
Natural Resources, State Parks Division, will receive bids at the time and date hereinafter specified, for the sale
of ballpark type foods, ice cream, and non-alcoholic beverages at “Pier 53” by concession contract at Wind
Creek State Park, Alexander City, Tallapoosa County, Alabama.
The park facilities to be operated by the successful bidder are specified in the concession contract for the park
and are available upon request. Each bidder should personally examine the facilities offered. Arrangements for
such examination shall be made by email or telephone request to: Toni Hart, Toni.Hart@dcnr.alabama.gov,

THE DEADLINE TO RECEIVE SEALED BIDS IS 2 PM CENTRAL TIME ON THURSDAY, APRIL
4, 2024. IT IS THE SOLE RESPONSIBILITY OF THE BIDDER TO ENSURE THE STATE PARKS
DIVISION ACTUALLY RECEIVES THE BID PRIOR TO THE ADVERTISED DEADLINE.
All bids should be submitted in sealed envelopes in the form and manner prescribed and should be
marked clearly on the outside of the envelope with the words “SEALED BID OPERATION OF PIER 53
FOOD AND DRINK CONCESSION AT WIND CREEK STATE PARK, TO BE OPENED AT 2 P.M.
CENTRAL TIME WEDNESDAY, APRIL 5, 2024” to avoid the opening of the bid as ordinary mail.
BIDS MUST INCLUDE THE PERCENTAGE AMOUNT THE BIDDER PROPOSES TO PAY THE STATE
OF ALABAMA, DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES, STATE PARKS
DIVISION BASED ON TOTAL SALES AS WELL AS ALL OTHER AMOUNTS REFERRED TO IN THE
CONCESSION CONTRACT. NO ALTERATIONS OR EXCEPTIONS SHALL BE ALLOWED TO THE
TERMS AND CONDITIONS OF THIS INVITATION, THE BID, AND CONTRACT. BIDS MUST BE
MAILED TO: ALABAMA DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES,
STATE PARKS DIVISION, ROOM 538, 64 NORTH UNION STREET, MONTGOMERY, ALABAMA,
36130. Bids will be opened at 2 PM Central Time on Friday, April 5, 2024, in the State Park Division’s
Conference Room, located at 64 North Union Street, Room 539, Montgomery, Alabama 36130.
The concession contract will be granted pursuant to the provisions contained in Section 9-14-20 et seq., Code of
Alabama (1975). All bidders must submit with their bids proof of at least five (5) years actual experience in the
operation of similar activities and a complete financial statement, which shall be subject to verification. The
experience required hereby must be personal experience if the bid is submitted by an individual, or it must be
the experience of the entity itself in the case of bids submitted by firms, companies, partnerships, associations or
corporations, etc.
The successful bidder will be required to provide a faithful performance bond, as well as insurance coverage, in
amounts as specified in the concession contract. All interested parties are notified that the successful bidder
will generally be required to provide items and equipment.
The successful bidder shall be responsible for the full maintenance and upkeep of the facilities, all equipment
used in connection therewith, and the grounds adjacent to said facilities. All rates, charges, and fees of
whatever kind shall be subject to audit and adjustment by the Commissioner of the Department of Conservation
and Natural Resources. The term of the concession contract shall run from the date of the Governor’s signture
and expire after a two-year period with an option to extend the term for an additional two (2) years by mutual
agreement of the parties.
The successful bidder shall have twenty (20) days after receipt of the concession contract to execute it and
furnish the performance bond, insurance policy, and all additional required information and documents
necessary to complete the contract process. In the event the successful bidder has not performed in the time
limit presented, the Commissioner may treat the failure as a refusal and the rights of the successful bidder may
be terminated.
The Commissioner of the Department of Conservation and Natural Resources reserves the right to reject any
and all bids. All requirements of State law not otherwise set out in this notice, governing the operation of these
facilities and the letting of this contract, shall apply to this invitation and any concession contract made pursuant
thereto.
Concessionaire agrees to comply with all applicable state and federal laws, including, but limited to,
nondiscrimination on the basis of age, race, religion, color, sex, pregnancy, genetic information, veteran status,
national origin or disability.
